What this is about

The Digital Services Act (Regulation (EU) 2022/2065, DSA for short) sets out the duties of providers of digital services in the EU - above all for handling illegal content and for moderation. On this page we explain how we are classified, what that means for you and which routes are open to you.

How we are classified

In Tellersonne you can publish comments, ratings and cooked photos. We store these contributions for you and disseminate them publicly. That makes us a hosting service and, in all likelihood, an online platform within the meaning of the DSA. We are a micro-enterprise: fewer than ten employees and less than two million euros of annual turnover. Should that change, the status continues to apply for another twelve months.

Which duties apply to us - and which do not

As a micro-enterprise we are exempt under Article 19 DSA from the additional platform duties of Articles 20 to 28, and likewise from the annual transparency reports under Article 15. Article 24 (3) remains: on request from the supervisory authority we state the average number of monthly active users in the EU. We calculate it from the accounts that had at least one active day within a rolling window of 35 days; several devices of the same person count once. Independently of that, the rules for all hosting services apply to us: points of contact (Articles 11 and 12), understandable terms of use (Article 14), the notice procedure (Article 16), statements of reasons for moderation decisions (Article 17) and reporting serious criminal offences (Article 18). We implement an internal complaint procedure, out-of-court dispute settlement and the handling of trusted flaggers voluntarily, although we are not obliged to.

Point of contact for authorities (Article 11)

Authorities, the Commission and the Digital Services Coordinator reach us electronically at abuse@tellersonne.app. Postal address: Albert-Schweitzer-Ring, 25524 Itzehoe, Deutschland. We handle requests in these languages: German, English. We act on orders under Articles 9 and 10 DSA without delay.

Point of contact for users (Article 12)

You reach us at the same address: abuse@tellersonne.app, in the languages German, English. There is a person behind it - we do not handle your message by automation alone. For questions about the app and your account, support@tellersonne.app is the faster route.

Legal representative (Article 13)

Only providers without an establishment in the Union need a legal representative in the EU. We are established in Germany; the address is in the legal notice at https://tellersonne.app/en/imprint. A legal representative is therefore not required. The competent supervisory body is the Digital Services Coordinator at the Bundesnetzagentur.

Reporting illegal content (Article 16)

Anyone can notify us of content they consider illegal - with an account and without. - In the app: the report button right on the comment or photo, then pick a reason. - Without an account or on the public recipe pages: the notice form at https://tellersonne.app/en/dsa. So that we can review quickly, we need an explanation of why the content is illegal, the exact location (ideally the link to the item), your name and e-mail address, and a confirmation that your statements are accurate and complete to the best of your knowledge. You may leave out name and e-mail when the notice concerns child sexual abuse material. You receive a confirmation of receipt and afterwards our decision, together with information about the available remedies.

What a statement of reasons contains (Article 17)

When we hide or remove a contribution, reject a photo, restrict commenting or lock an account, the person concerned receives a statement of reasons. It says: - which measure we took and how long it lasts, - which contribution it concerns, - whether the decision follows a notice or our own review, and whether automated means were used, - whether we rely on a legal provision or on our terms of use, and which one, - a short explanation of the facts and circumstances, - which remedies are available: the internal complaint procedure, out-of-court dispute settlement and the courts. We send the statement of reasons as a message to the notification centre in the app and, where a confirmed mailbox exists, by e-mail as well.

Internal complaint procedure (Article 20)

You can lodge a complaint against every moderation decision for six months - including when your notice did not lead to a measure. The complaint is free of charge. You start it straight from the message in the app or by e-mail to abuse@tellersonne.app. Every complaint is reviewed by a person who was not involved in the first decision; we do not decide by automation alone. We answer promptly, give reasons for the outcome and reverse a measure when the complaint is justified.

Out-of-court dispute settlement (Article 21)

If you do not agree with the outcome, you can turn to a dispute settlement body certified under Article 21 DSA. These bodies are certified by the Digital Services Coordinator of the respective member state; the European Commission keeps a list. We engage in such proceedings in good faith. The decision of the body is not binding on the parties.

Going to court

Independently of complaints and dispute settlement, you can go to court at any time. None of the routes described here is a precondition for that, and none of them rules it out.

Misuse of notices and complaints (Article 23)

Anyone who repeatedly publishes manifestly illegal content, or submits manifestly unfounded notices and complaints in series, is warned first. If that does not help, we suspend commenting for a reasonable time or - in serious or repeated cases - lock the account; a locked account can no longer report from the app. A person from our team decides on each of these measures; there is no automatic counter that leads to a suspension on its own. We take into account how many items are affected, how serious the misuse is and whether it was deliberate. You receive a statement of reasons for such a measure too and can lodge a complaint against it.

If your account is locked

Locking an account also ends your sign-in. So that the complaint route stays open to you, we send the full statement of reasons including all remedies to your confirmed e-mail address as well. You can then lodge the complaint informally by e-mail to abuse@tellersonne.app - it is treated exactly like a complaint made from the app. If a deletion of your account is scheduled, you can still sign in and use the route inside the app.

Orders from authorities (Articles 9 and 10)

Orders to act against illegal content and orders to provide information from judicial or administrative authorities are received at the point of contact for authorities. We confirm receipt, act within the period the law prescribes and inform the person concerned as soon as that is permitted - in the case of a removal with the same statement of reasons as for any other measure. For orders under Regulation (EU) 2021/784 on terrorist content online, the statutory period of one hour from receipt applies.

Criminal offences (Article 18)

If we suspect that content points to a criminal offence involving a threat to the life or safety of a person, we inform the competent law enforcement or judicial authorities without delay and make the available information accessible to them. Content showing child sexual abuse material is removed immediately and reported to the competent bodies.

Trusted flaggers (Article 22)

Notices from entities recognised as trusted flaggers by a Digital Services Coordinator are handled with priority and without undue delay. Recognised entities are welcome to contact us in advance at abuse@tellersonne.app so that we can mark the account accordingly.

Transparency

As a micro-enterprise we are exempt from the transparency reports under Article 15 DSA. Because we still believe in being open, we publish a short overview once a year at https://tellersonne.app/en/dsa: how many notices came in, how many measures we took, how many complaints there were and how many of them succeeded, how often automated checks were involved and how long we needed on average. Orders from authorities are listed separately. These figures are voluntary and do not follow the reporting format for larger platforms.

No advertising, no profiling-based recommendations

Tellersonne shows no advertising and does no tracking across apps or websites. The suggestions under "For you" are based on what you set and do in the app - such as your dietary settings and saved recipes - and not on purchased profiles. There are no recommendations to minors based on profiling.
